GENERAL TERMS AND CONDITIONS OF SALE — JOUNEN

Article 1 – Seller Identification

These General Terms and Conditions of Sale are provided by:

Hereinafter referred to as JOUNEN.

These General Terms and Conditions of Sale govern sales made to consumers through the JOUNEN online store.

Article 2 – Products

JOUNEN sells, in particular, products and accessories intended for content creation.

The essential characteristics of the products are presented on the relevant product pages before an order is placed.

Customers are required to review this information before making a purchase.

Product photographs and presentations are intended to represent the items offered as accurately as possible, without affecting the essential characteristics stated on the product page.

Article 3 – Product Compatibility

Certain JOUNEN products are available with different connector options, including USB-C and Lightning (iPhone).

Customers are advised to check the connector used by their device before selecting a product variant.

An error in selecting the variant does not deprive the consumer of any statutory rights, including the right of withdrawal where applicable.

Article 4 – Prices

The prices displayed on the JOUNEN online store are the prices applicable at the time the order is placed.

Prices are shown in the currency applicable to the customer’s market and include applicable taxes where required by law.

Any shipping charges, duties, taxes or other applicable fees are displayed before the customer confirms the order, where applicable.

JOUNEN reserves the right to change its prices at any time. However, any price change will not affect an order that has already been confirmed.

Article 5 – Orders

The customer selects the desired product and, where applicable, the relevant variant and quantity.

Before finally confirming the order, the customer may review its contents and correct any errors.

Confirmation of the order entails an obligation to pay.

An order confirmation is then sent to the email address provided by the customer when placing the order.

JOUNEN may refuse or cancel an order in the circumstances permitted by applicable law, including in cases of fraud or payment issues, without prejudice to the consumer’s statutory rights.

Article 6 – Payment

Payment is made using the payment methods offered on the online store at the time of purchase.

The total amount of the order is communicated to the customer before final confirmation.

The order is considered definitively accepted only after payment has been approved, subject to applicable legal provisions.

Transactions may be processed by secure payment service providers made available through the online store.

Article 7 – Delivery

Orders are delivered to the destinations offered by JOUNEN during checkout.

The customer must provide a complete and accurate delivery address.

The applicable delivery timeframe is communicated to the customer before the contract is concluded.

JOUNEN remains responsible to the consumer for the proper performance of its contractual obligations in accordance with applicable law.

Applicable law requires the seller to provide a delivery date or delivery timeframe before the contract is concluded and provides consumers with remedies if that commitment is not met.

Article 8 – Right of Withdrawal

In accordance with the French Consumer Code, consumers generally have 14 days from receipt of the goods to exercise their right of withdrawal, without having to provide a reason.

To exercise this right, the customer must clearly inform JOUNEN of their decision, including by email at:

Following notification of withdrawal, the consumer has the applicable statutory period to return the product.

The direct cost of returning the product when exercising the right of withdrawal is borne by the consumer where they have been informed of this in advance, unless otherwise stated by JOUNEN.

French law provides consumers with at least 14 days to withdraw from a distance purchase.

Article 9 – Refund Following Withdrawal

Where the right of withdrawal has been validly exercised, JOUNEN will refund the amounts due in accordance with the conditions and time limits required by applicable law.

Refunds are generally made using the same payment method used for the original transaction, unless otherwise agreed in accordance with applicable law.

JOUNEN may defer the refund in the circumstances permitted by law, including until the goods have been received or until the consumer provides proof of having sent them back, where applicable.

Article 10 – Damaged, Defective or Incorrect Products

Customers are advised to contact JOUNEN promptly if a product received is damaged, defective or different from the product ordered.

The customer may provide their order number and photographs showing the issue.

This practical procedure does not limit any rights the consumer may have under applicable statutory warranties.

Article 11 – Statutory Warranties

Products sold by JOUNEN are covered by applicable statutory warranties, including:

  • the legal guarantee of conformity;
  • the warranty against hidden defects.

The legal guarantee of conformity protects consumers, in particular, where a product does not conform to the contract. For applicable goods, this protection applies for the period provided by law, including two years for new goods.

Statutory warranties apply independently of any commercial warranty that may also be offered.

Article 12 – Liability

JOUNEN is responsible for the proper performance of its obligations in accordance with applicable law.

The customer is responsible for using the product in accordance with its intended purpose and any instructions provided.

Nothing in these General Terms and Conditions of Sale excludes or limits any mandatory consumer right granted by law.

Article 13 – Personal Data

Personal data required for processing orders is handled in accordance with applicable data protection legislation.

Detailed information regarding the collection and use of personal data and the rights available to customers is provided in JOUNEN’s Privacy Policy.

Article 14 – Intellectual Property

Elements belonging to JOUNEN and appearing on the online store, including the trademark, logo, texts and original creations, are protected under applicable intellectual property laws.

Any unauthorized use is prohibited, subject to exceptions provided by law.

Article 16 – Consumer Mediation

In the event of a dispute, the customer must first submit a complaint to JOUNEN in an attempt to reach an amicable solution.

If no agreement is reached following this prior complaint, the consumer may refer the dispute, free of charge, to the consumer mediator appointed by JOUNEN.

Article 17 – Applicable Law and Disputes

These General Terms and Conditions of Sale are governed by French law, without depriving a consumer residing in another country of any mandatory consumer protection provisions available under applicable law.

In the event of a dispute, the parties are encouraged to first seek an amicable solution.

If no amicable solution or mediation is successful, the consumer may bring the matter before the competent court in accordance with applicable legal rules.

Article 18 – Amendments to the Terms and Conditions

JOUNEN may amend these General Terms and Conditions of Sale, in particular to reflect changes in its activities or applicable regulations.

The terms applicable to an order are those accepted by the customer at the time the order is placed.
